Paying Employees in New Mexico

New Mexico 2024 Minimum Wage:

  • $12.00 per hour

 

New Mexico Overtime Rules:

  • 1.5 x’s the regular rate of pay (for non-exempt employees) for all hours worked over 40 in a workweek

  • Employee’s gross pay,

How often do you have to pay employees in New Mexico?

  • Employees must be paid by the 25th of the month for wages earned from the 1st – 15th of that month, and by the 10th of the following month for wages earned between the 16th and end of the month.

 

When is an employee’s final check due in New Mexico?

  • Voluntary resignation – next regular payday 
  • Involuntary terminations – due within five days of discharge for terminations (or ten days if paid by task, piece or commission).
